Terms of Service

These terms explain how you may use this website, what a quote request commits you to, how bookings and cancellations work, and the limits of our responsibility.

1. Who we are

Benny's Lawn Care & Snow Removal ("Benny's", "we", "us") is a residential property services company based in Ottawa, Ontario. We provide seasonal lawn care through the growing season and snow-blower-based driveway clearing through the winter, with optional walkway, porch, step and ice-melt add-ons. We do not provide commercial service, parking-lot clearing, or heavy-equipment work. By using this website or requesting an estimate, you agree to these terms.

2. Website information is illustrative

Pricing categories, starting prices, service descriptions, photography, coverage maps and weather information shown on this website are illustrative and may change without notice. They are not an offer of service and do not form a contract. Your written estimate and signed seasonal agreement are the only binding statements of price and scope.

3. Quote requests are not bookings

Requesting an estimate is free and places you under no obligation. Nothing is scheduled and no payment is collected until you receive a written estimate and approve it in writing.

We may decline, adjust or withdraw a request if the address falls outside our service area, if the property is not residential, if the property cannot be serviced safely with our equipment, or if capacity for the season is full.

4. Booking policy

A booking is confirmed only once you have (a) received a written estimate, (b) accepted it or signed the seasonal service agreement, and (c) satisfied any deposit or payment terms stated in that agreement. We will confirm your booking by email.

Seasonal programs are sold for a defined season with a defined start and end date. Service dates, snowfall triggers, visit frequency and arrival windows are set out in your agreement, not on this website. Where the property details you provided differ materially from the property we attend, we may revise the price before service continues.

5. Changes and cancellations

Requests to change, pause or cancel service must be made in writing to us using the contact details below. The notice periods, refunds and pro-rating that apply to your season are set out in your signed agreement and in our cancellation policy.

We may suspend or end service where access is unsafe, where payment is overdue, or where the property or conduct on site puts our crew or equipment at risk. Where we end service without cause, unearned prepaid amounts are refunded.

6. Access, site conditions and your responsibilities

You agree that the property details, contact information and photos you submit are accurate, and that you are the owner or are otherwise authorised to request service for the property.

Before a visit, please keep the service area clear of vehicles, bins, hoses, toys, pet waste, cords, decorations and other obstructions, and keep pets indoors. Mark anything fragile or hidden — sprinkler heads, low-voltage lighting, invisible fence wire, edging, pavers, downspout extensions and similar items. Unmarked or concealed items cannot be avoided reliably and are not our responsibility.

7. Weather, timing and service windows

Lawn and snow work depend on weather. Visit timing may shift with snowfall totals, storm duration, freezing rain, rainfall, growth rates, daylight and route conditions. We work through routes in the order that is safest and most efficient, so arrival times are estimates rather than guarantees. Snow clearing during an active or extended storm may require more than one pass, and municipal plows can deposit a windrow across a cleared driveway after we leave.

8. Fully licensed and insured

Benny's Lawn Care & Snow Removal is fully licensed and insured. Insurance details are available before service begins and are shared together with your written agreement.

9. Limitation of liability

We take care on every property, and we are responsible for damage caused by our own negligence. Report any suspected damage to us within 48 hours of the visit, with photos, so we can inspect it while the cause can still be determined.

To the fullest extent permitted by Ontario law, we are not responsible for: normal wear from seasonal service, including minor turf or edge marking and salt-related effects on lawns and plantings; damage to unmarked or concealed items listed in section 6; pre-existing defects in driveways, walkways, sod, interlock or structures; damage caused by weather, ice formation, freeze-thaw cycles, municipal plows or third parties; or losses arising from delayed or missed visits during a storm or equipment failure.

Except where liability cannot legally be limited, our total liability arising from the services is limited to the amount you paid us for the season in which the claim arose, and we are not liable for indirect, incidental or consequential losses, including lost income, travel costs, or third-party service costs. Nothing in these terms limits rights you have under applicable consumer protection legislation.

10. Slip, trip and ice

Snow clearing and ice-melt application reduce but cannot remove the risk of slippery surfaces. Ice can re-form after service, particularly during freeze-thaw conditions or freezing rain. Surfaces should always be treated as potentially slippery, and you remain responsible for the general upkeep and safety of your property between visits.

11. Payment

Prices, payment schedule and accepted payment methods are stated in your written estimate and agreement. Amounts are in Canadian dollars and applicable taxes are added where required. Overdue balances may result in service being paused until the account is brought current.

12. Accounts

You are responsible for keeping your account password confidential and for activity carried out under your account. Tell us right away if you believe your account has been used without your permission.

13. Photos and records

Our crews may take before-and-after photos to document site conditions and completed work. These are kept as service records. We do not publish identifiable property photos for marketing without your permission. How we handle your information is described in our Privacy Policy.

14. Your agreement governs service

Season dates, service triggers, snowfall thresholds, arrival windows, pricing and cancellation terms are set out in the written seasonal service agreement issued to you individually. Where this website and your signed agreement differ, your agreement applies.

15. Governing law and changes to these terms

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there.

We may update these terms as the service grows. The date above shows when they were last revised. Material changes affecting an active agreement are communicated directly to you.
